해외 방문학자 과정을 가기 위해 여러 서류를 준비하는데, 이중에서 가장 중요한 것이 연구계획서입니다. 현지에 있는 교수님이 전문적으로 다루는 주제 혹은 연구 방향하고 일치한다면, 초청을 받기가 더 쉬워지기 때문에 가고자 하는 대학/학과의 교수님의 연구 관심 분야를 잘 살펴봐야 하고, 본인 스스로도 깊이 탐구하고자 하는 주제 혹은 분야인지 판단해서 결정해야 합니다.
그러면, 연구계획서는 어떤 내용을 담아 작성해야 할까요? 최고의 연구계획서를 쓰고자 한다면, 다음의 내용을 포함시키라는 Russell Sage Foundation의 ‘Apply to be a visiting Scholar’의 FAQ에서 따온 내용을 읽어 보시기 바랍니다.
- 프로젝트의 중요성을 나타내고
- 관련성이 있는 적절한 문헌을 인용해야 하며
- 다뤄질 주요 질문이나 가설을 강조하고
- 사용될 데이터 출처를 나타내고
- 일반적인 연구 방법론 또는 분석전략을 설명하고
- 방문 기간 동안 어떤 결과가 도출될 것인지를 기술해야 합니다.
방문학자로 가고자 하는 대학이나 기관에서 지원자의 연구계획서와 이력서를 보고 자신의 학교에 적합한 인물인지를 판단하고 초청합니다. 그런 중요한 서류이니 연구 주제를 잘 잡고 대학 측이 요구하는 분량(주로 1~3페이지)을 잘 채워 나가야 합니다.
오늘은 방문학자 과정을 제공하는 대학 중 영국의 University of Birmingham의 Birmingham Law School에 대해서 알아보겠습니다.
버밍엄 대학은 레드브릭 대학의 원조이자 명문으로 알려진 러셀 그룹의 일원인 대학입니다. 학생들은 이곳에서 다양한 강좌를 수강하고, 우수한 캠퍼스 및 연구 시설을 누리게 됩니다.
2022년 최근 Complete University Guide 리그 테이블에서 버밍엄은 130개 조사 대학 중 19위를 차지했습니다. 영국에는 매년 발표하는 3대 대학 랭킹 기관이 있는데, Complete University Guide, The Guardian, The Sunday Times(The Times와 공동으로) 가 있습니다. 과거에 데일리 텔레그래프와 파이낸셜 타임즈에 의해 순위가 산출되었지만, UK 리그 테이블이라고 하면, 영국내 대학 랭킹을 보는 것으로 컴플리트 유니버시티 가이드, 가디언, 타임즈입니다. 2008년 이후로 Times Hight Education이 매년 3대 리그 결과를 합해 ‘Table of Tables’를 만들어 왔습니다. 2021년 테이블에서 Top 5에 든 대학이 캠브리지, 옥스포드, 세인트 앤드류, LSE, 더럼대학입니다. 이들 대학에 비하면, 버밍엄 대학은 한참 순위에 벗어나지만, 그래도 세개의 테이블에서 매년 좋은 성적을 거두고 있습니다.
버밍엄대학의 로스쿨에서도 매년 방문학자의 지원서를 받고 있습니다. 작년에는 코로나로 인해서 화상으로 방문학자 프로그램에 참여했지만, 2021년부터 대면식의 방문이 가능하다고 하니 예년과 같이 준비하면 되겠습니다.
방문학자 과정은 로스쿨 내에서 연구를 수행하고 버밍엄 대학의 대학 생활에 참여하길 희망하는 다른 기관의 학자에게 열려 있습니다. 지난 80년 동안 버밍엄 로스쿨은 교육과 학문에 주요한 기여를 해왔으며, 스쿨은 광범위하게 근거지를 두고 버밍엄 대학의 다른 과목인 철학, 정부와 사회, 의학을 포함해서 많은 연계가 있습니다. 교수들은 국내 최고의 법률 학자 중 하나로 법률 및 법률 관련 주제에 관한 학술 문헌에 정기적으로 기고하고 있습니다.

Example answer: During my visit, I propose to engage in two principal research projects. The first is a jointly-authored paper that forms part of a series which I am writing with Mr Brown. This article will be entitled “Questioning the Domestic and Commercial Context in the Law of Trusts”, and in which we will develop our previous arguments first articulated in an extended case comment, “‘Less than straightforward’ people and trusts: reflections on context” [2013] Conv 431. This proposed article argues that the domestic and commercial distinction that governs which trust is to apply to which situations, is too rigid to deal with the range of human relationships and dealings in the modern society. It examines the stream of cases decided after Stack v Dowden [2007] 2 AC 432 that have shown varied factual patterns, and which throw up difficult issues concerning the rationality and applicability of the distinction. The article also considers the residual role for the presumed resulting trust in the domestic context, as well as how proprietary estoppel is to fit into the legal analysis with the bifurcation of the resulting trust and constructive trust scenarios. Our work during my proposed visit should result in an output suitable for submission to a subject-specific journal, for example, the Conveyancer and Property Lawyer or Journal of Equity. This first article will lay the groundwork for a second joint piece exploring the other areas of uncertainty/difficulty regarding the new framework of analysis for the English common intention constructive trust. We hope to complete and submit the second article to a leading generalist journal in 2015. The second project that I plan to work on during my visit is a sole-authored paper that I will be presenting at the 7 th Biennial Conference on the Law of Obligations at the University of Hong Kong. The paper is entitled “Modern Law of Trusts in Singapore: Nationalism and Internationalism”. This paper draws several lessons from an examination of the influence of foreign law on the Singapore law of equity and trusts. The Singapore experience shows that convergence at one area of the law of equity and trusts may affect other areas. Indeed, it is too simplistic to merely observe points of convergence and divergence in the common law world without assessing the underlying reasons for these developments. This paper shall examine the dynamism and sustainability of the “common law” both as a term and an enterprise and how they are closely tied in with the incremental developments within each jurisdiction and the resultant convergence and divergence across the jurisdictions. This paper is part of a series of sole-authored works addressing the same theme. I plan to submit this paper to an international journal such as the International Comparative Law Quarterly or Melbourne University Law Review. Any publications resulting from my visit would fully and gratefully acknowledge my period as a Visiting Scholar at Birmingham Law School. I would only require a workspace and library access for the duration of this visit.
